THE TERMS & CONDITIONS

1. General Information

These Terms and Conditions (“Terms”) govern the use of this website and all related services provided by [Megan May Films] (“Company,” “we,” “us,” or “our”). By accessing or using our website or services, you agree to be bound by these Terms. If you do not agree, please do not use this website or engage our services. The Company is a limited liability company organized under the laws of the State of California, providing wedding and event videography services primarily within California and to select destination locations.

2. Services
The Company provides professional videography and film editing services for weddings, elopements, and related events. Specific details, deliverables, and timelines for each project are defined in a written service agreement provided to each client prior to booking.

3. Booking and Payment Terms
To secure your event date, a non-refundable 25% retainer is required at the time of booking. This retainer is applied toward the total balance.
50% of the total balance is due 30 days prior to the event date. The remaining 25% balance is due on the day of the event, prior to the commencement of filming. All payments must be made via approved payment methods specified in the service agreement. The booking is not confirmed until the retainer and signed agreement are received.

4. Cancellations and Refunds
The retainer is non-refundable under any circumstances. If a client cancels the event more than 60 days prior to the scheduled date, any payments beyond the retainer will be refunded. Cancellations made within 60 days of the event will forfeit all payments made to date. In the event that the Company must cancel due to unforeseen circumstances (illness, emergency, or other force majeure event), the client will receive a full refund of all payments made, including the retainer, or may choose to reschedule based on mutual availability.

5. Travel and Accommodation
For events outside a 50-mile radius of [Videographer’s City, CA], travel fees may apply, including but not limited to mileage, airfare, lodging, and per diem expenses. All travel arrangements must be approved in writing prior to the event date. For destination weddings requiring airfare or hotel accommodations, travel arrangements must be finalized no later than 30 days prior to the event.

6. Artistic Rights and Creative Direction
By engaging the Company, the client acknowledges and agrees to trust the videographer’s professional judgment in capturing and editing the event. The Company retains full artistic discretion regarding shooting style, editing decisions, and selection of delivered footage. No raw footage is provided unless explicitly purchased as an add-on.

7. Copyright and Usage Rights
All video footage, audio, and edited works are the intellectual property of the Company and are protected under U.S. copyright law. The Company grants the client personal, non-commercial usage rights to share and display the final films for personal purposes (e.g., on social media, personal websites, or with family and friends). The client may not sell, license, or commercially distribute the footage without written consent. The Company reserves the right to use footage and stills for promotional purposes, portfolio display, social media, website content, and advertising unless otherwise agreed in writing.

8. Delivery of Final Films
Final films are typically delivered within 8–12 weeks following the event date, unless otherwise stated in the service agreement. Delivery is made via digital download link or client gallery.
Delays due to unforeseen circumstances (technical issues, illness, natural disasters) will be communicated promptly.

9. Limitation of Liability
While every effort is made to ensure the highest quality of service, the Company’s liability for any claim, loss, or injury arising from performance or non-performance of services shall be limited to a refund of the fees paid by the client. The Company shall not be liable for indirect, consequential, or incidental damages, including loss of emotional or sentimental value associated with event footage.

10. Force Majeure
The Company shall not be held responsible for delays or inability to perform caused by circumstances beyond reasonable control, including but not limited to weather, illness, accidents, natural disasters, acts of God, government restrictions, or transportation interruptions. In such cases, the Company will make reasonable efforts to reschedule or refund payments as appropriate.
